Sponsored by: Senator(s) Meier and Craft and Representative(s) Allen, Clem, Jaggi and Sommers A BILL for AN ACT relating to revenue distribution; specifying distribution of registration fees; providing for a grant program for registration fees as specified; specifying distribution of severance taxes; providing rulemaking authority; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 24 ‑ 2 ‑ 116 is created to read: 24 ‑ 2 ‑ 116 . County and municipal road grant program. (a) The department of transportation shall operate a county and municipal road grant program in accordance with this section. Applications for a grant under this section shall be on forms prescribed by and subject to rules promulgated by the department. Counties or municipalities applying for a grant under paragraph (i) or (ii) of this subsection shall specify how the project qualifies for a grant under this section. The department shall determine which counties or municipalities are eligible for grants under this section as follows: (i) For a grant of funds received by the department pursuant to W.S. 31 ‑ 3 ‑ 103(b )(i), the department shall issue grants which w ill be used exclusively by a county for maintenance and construction of county roads which were previously owned and maintained by the state; (ii) For any funds received by the departmen t pursuant to W.S. 31 ‑ 3 ‑ 103(b)( i) which are not expended under paragraph (i) of this subsection , the department shall issue grants to municipalities as provided under this paragraph for road maintenance and construction . Grants under this paragraph shall not include any matching requirement and shall be issued by the department through a ranking system based on the road condition in the municipality and the financial need of the municipality considering : (A ) The municipality's per capita sales and use tax distributions under W.S. 39 ‑ 15 ‑ 111 and 39 ‑ 16 ‑ 111 using population as determined by the most recent decennial federal census as defined in W.S. 8 ‑ 1 ‑ 102(a)(xv) and as reported by the economic analysis division within the department of ad ministration and information ; and (B) Whether additional local funding may be available considering: (I ) The number of mills imposed by the municipality as authorized by article 15, section 6 of the Wyoming constitution; and (I I) The level of local optional sales and use taxes imposed by the municipality under W.S. 39 ‑ 15 ‑ 204 and 39 ‑ 16 ‑ 204. Section 2 . W.S. 31 ‑ 3 ‑ 103(b) and 39 ‑ 14 ‑ 801(b) (intro) and by creating new paragraphs (iii) through (v) are amended to read: 31 ‑ 3 ‑ 103 . Distribution of fees; refunds. (b) Fees collected pursuant to W.S. 31 ‑ 3 ‑ 101(a)(i) and subsection (a) of this section shall be distributed by county treasurers in the same proportions and manner as property taxes are distributed , . provided that a portion of the fees equal to the amount of funds transferred under W.S. 39 ‑ 14 ‑ 801(b)(iv ) which would otherwise be distributed to a local school district or for distribution to the school foundation program account shall be distributed as follows: (i) Fifty percent (50%) shall be transferred to the Wyoming department of transportation to provide grants to counties which shall be used exclusively for road maintenance and construction for county roads that were previously owned and maintained by the state as provided in W.S. 24 ‑ 2 ‑ 116( a ) (i) ; and (ii) Fifty percent (50%) shall be transferred to the highway fund. 39 ‑ 14 ‑ 801 . Severance tax distributions; distribution account created; formula. (b) Before making distributions from the severance tax distribution account under subsections (c) through (e) of this section, an amount equal to two ‑ thirds (2/3) of the amount of tax collected under W.S. 39 ‑ 14 ‑ 104(a)(i) and (b)(i) and 39 ‑ 14 ‑ 204(a)(i) for the same period shall be deposited as follows: ( iii ) Thirty ‑ three and one ‑ third percent (33 1/3%) into the permanent Wyoming mineral trust fund ; , except that for the fiscal year 2010 these funds shall be deposited as follows: (iv ) Thirt y ‑ three and one ‑ third percent (33 1/3%) to backfill the amount dist ributed as provided in W.S. 31 ‑ 3 ‑ 103(b)(i) and (ii); and ( v ) Thirty ‑ three and one ‑ third percent (33 1/3%) to the common school account in the permanent land fund, provided that if there is any deficit in the school foundation program account an amount equal to the amount of the deficit shall first be deposited into the school foundation program account. Section 3 . W.S. 39 ‑ 14 ‑ 801(b)(i) and (ii) is repealed. Section 4 . This act is effective July 1, 201 6 . (END) 1 SF0127
