WORKING DRAFT 2015 STATE OF WYOMING 15LSO-0150 Numbered 2.1 Senate JOINT RESOLUTION NO. SJ0003 Limitation of authority. Sponsored by: Senator(s) Wasserburger A BILL for A JOINT RESOLUTION requesting Congress submit to the states a proposed amendment to the United States Constitution prohibiting the infringement of the United States government on the states' educational rights. WHEREAS, t he Tenth Amendment to the United States Constitution states " The powers not delegated to the United States by the Constitution, nor prohibited by it to t he states, are reserved to the s tates respectively, or to the people " ; and WHEREAS, the United States Constitution does not delegate the power over education to the United States, it is a power reserved to the s tates or the people ; and WHEREAS, the authority and power of the United States government over education shall not increase with the creation of t he United States department of e ducation ; and WHEREAS, the United States government shall not diminish the power over education reserved to the states or local school systems or other instrumentalities of the states; and WHEREAS, the United States government shall not impose unfunded mandates, sanctions, financial or otherwise, against the educational institutions of the states, or the states, respectively. NOW, THEREFORE, BE IT RESOLVED BY THE MEMBERS OF THE LEGISLATURE OF THE STATE OF WYOMING : Section 1. That procedures be instituted in Congress to add a new Article to the Constitution of the United States, and that Congress prepare and submit to the several states an amendment to the United States Constitution that prohibit s the infringement of the United States government on the states ' educational rights and reserves the authority to govern education to the States or its people . Section 2. That the Secretary of the State of Wyoming transmit copies of this resolution to the President of the Senate and the Speaker of the House of Representatives of Congress and members of the Wyoming Congressional Delegation.
