This act provides for the return of evidence
to its owner
if
the prosecuting attorney determines that
using photographs of the evidence would not substantially prejudice any criminal proceeding.

This act provides that
the prosecuting attorney shall
make this determination
within sixty
(60)
days of when the property was taken.

This act provides exclusions for contraband, property subject to evidentiary analysis and property
whose
ownership is disputed.

A BILL

for

AN ACT relating to the victim and witness bill of rights; providing for the return of property where photographs may be submitted into evidence in place of the property as specified; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Prompt return of property.

(b)

Criminal justice agencies shall work together to expedite the return of property when it is no longer needed. Prosecuting attorneys shall promptly notify law enforcement agencies when evidence is no longer needed.

prosecuting
attorney
shall
determine

whether
photographs of property are admissible as evidence and
submitting the photographs
into evidence in place of the property w
ill
not substantially prejudice
any criminal proceeding
. If the
prosecuting
attorney determines use of a photograph as evidence in lieu of the property will not substantially prejudice any criminal proceedings,

the
property

shall be photographed and returned to the owner.
Contraband shall not be subject to this subsection. Property subject to evidentiary analysis and property of which ownership is disputed shall not be subject to provisions providing for use of photographs as evidence in lieu of the property.
