Subject: Public records definition and st udent electronic communications Summary/Major Elements: For purposes of the Public Records Act, “ public records ” is defined as any information in a physical form created, accepted, or obtained by the state or any agency, institution or political subdivision of the state in furtherance of its official function and transaction of public business which is not privileged or confidential by law. This act adds to that definition to provide that: Electronic communications solely between students attending the University of Wyoming, any community college and any public school within a school district in the State are not a public record of that school; Electronic communications solely between students attending the University of Wyoming, any community college and any public school within a school district in the State and a sender or recipient using a non-school user address are not a public record of that school. ORIGINAL House Bill No . HB0013 ENROLLED ACT NO. 25, HOUSE OF REPRESENTATIVES SIXTY-THIRD LEGISLATURE OF THE STATE OF WYOMING 2016 Budget Session AN ACT relating to public records; amending definition to provide student electronic communications are not public records as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 16 ‑ 4 ‑ 201( a)(v) is amended to read: 16 ‑ 4 ‑ 201 . Definitions. (a) As used in this act: (v) " Public records " when not otherwise specified includes any information in a physical form created, accepted, or obtained by the state or any agency, institution or political subdivision of the state in furtherance of its official function and transaction of public business which is not privileged or confidential by law. Without limiting the foregoing, t he term " public records " in cludes any written communication or other information, whether in paper, electronic, or other physical form, received by the state or any agency, institution or political subdivision of the state in furtherance of the transaction of public business of the state or agency, institution or political subdivision of the state, whether at a meeting or outside a meeting . Electronic communications solely between students attending a school in Wyoming and electronic communications solely between students attending a school in Wyoming and a sender or recipient using a non s chool user address are not a public record of that school. As used in this paragraph, a " school in Wyoming " means the University of Wyoming, any community college and any public school within a school district in the state ; Section 2 . This act is effective July 1, 201 6 . (END) 1
