Subject: Concealed weapons permit for milita ry applicants outside the state Summary/Major Elements: Current Wyoming law requires applicants for a concealed weapons permit to complete an application under oath and submit the application to the sheriff’ s office in the county of the applicant’ s residence. This bill provides a procedure for applicants in military service outside the state to apply for a concealed weapons permit without coming to the state, provided that the applicant : S ubmits proof of Wyoming residency, a certification of the applicant’ s active military service outside the state and a notarized affidavit testifying in writing that the statements in the application are true and accurate; and Otherwise meets applicable requirements under statute for applying for a concealed weapons permit. This bill requires the Attorney General to promulgate rules and regulations necessary to implement the act. Comments: That portion of the bill requiring rules by the Attorney General is effective immediately in order to allow the rules to be promulgated before a July 1, 2016, deadline. ORIGINAL House Bill No . HB0043 ENROLLED ACT NO. 22, HOUSE OF REPRESENTATIVES SIXTY-THIRD LEGISLATURE OF THE STATE OF WYOMING 2016 Budget Session AN ACT relating to concealed weapons; providing a procedure for applicants in military service outside the state to apply for a concealed weapons permit as specified; and providing for effective dates. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 6 ‑ 8 ‑ 104 (d) (intro), (e) (i) and by creating a new paragraph (v) a nd by creating a new subsection (cc) is amended to read: 6 ‑ 8 ‑ 104 . Wearing or carrying concealed weapons; penalties; exceptions; permits. (d) Except as provided in subsection (cc) of this section, t he application shall be completed, under oath, on a form promulgated by the attorney general to include: (e) T he applicant shall submit to the division through the sheriff's office in the county of the applicant's residence: (i) A completed application as described in subsection (d) of this section or, if applicable, subsection (cc) of this section ; (v) If applicable, the items listed in subsection (cc) of this section. (cc) The attorney general shall by rule and regulation provide a procedure under which an applicant who is in active military service outside the state of Wyoming but otherwise meets the requirements specified in subsection (b) of this section may apply for a permit to carry a concealed firearm under this section without appearing in Wyoming . Application s under this subsection shall require : (i) T he items listed in subsection (d) of this section ; (ii) P roof of residency in a form acceptable to the attorney general that shows the applicant meets the requirements specified in subsection (b) of this section; (iii) C ertification of the applicant's active military service outside the state ; (iv) A notarized affidavit from the applicant testifying in writing that the statements in the application are true and accurate . The affidavit required by this paragraph subject s the applicant to criminal prosecution under W.S. 6 ‑ 5 ‑ 303 ; and (v) A ny other information required by rule and regulation of the attorney general. Section 2 . The attorney general shall promulgate rules and regulations necessary to implement this act by July 1, 2016. Section 3 . (a) Except as provided in subsection (b) of this section, this act is effective July 1, 201 6 . (b) Section 2 of this act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
