Subject: Provides increased Medicaid reimbursement s for nursing homes who partner with government-owned health care entities and who pay into a state fund that is used to obtain matching fu nds from the federal government Summary/Major Elements: This bill requires the Department of Health to seek a state Medicaid plan amendment. The amendment would allow nursing care facilities who transfer ownership to state-owned governmental entities, including memorial hospitals, hospital districts and rural health care districts, to pay into a state fund. Monies in the fund are used to obtain reimbursements from Medicaid. Once rec eived, the reimbursements are combined with the original payments and distributed back to the nursing care facilities who pay into the fund. Distributions are made in an amount necessary to compensate nursing care facilities up to the upper payment limit set by applicable federal law. The Department of Health is required to make application for the state Medicaid plan amendment on or before July 1, 2016. ORIGINAL House ENGROSSED Bill No . HB0074 ENROLLED ACT NO. 46, HOUSE OF REPRESENTATIVES SIXTY-THIRD LEGISLATURE OF THE STATE OF WYOMING 2016 Budget Session AN ACT relating to the Wyoming Medical Assistance and Services Act (Medicaid); authorizing the department of health to obtain an amendment to the state plan for the governmental nursing facility and private nursing facilities transferring ownership of nonstate owned governmental entities gap payment program; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . Before July 1, 2016, the department of health shall make application to the federal department of health and human services for an amendment to the state plan for medical assistance and services developed under W.S. 42 ‑ 4 ‑ 104(a)(ii). The application shall seek a plan amendment to allow the department to operate programs funded through permissible provider and local government contributions or through available federal funding. These programs, if approved in a plan amendment, shall be budget neutral to the state of Wyoming and shall cover administrative expenses incurred by the department of health or its agent in performing the activities authorized by this bill, provided that these expenses shall not exceed a total of one percent (1%) of the aggregate assessment funds collected in the fiscal year. These programs shall provide supplemental payments to participating government owned nursing facilities . To be eligible for the supplemental payments, private nursing facilities may transfer ownership to hospital districts, memorial hospitals or rural healthcare districts. The goal of the supplemental payments is to compensate the facilities for care provided to Medicaid patients up to the upper payment limit applicable to each facility. Section 2 . This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
