A BILL for AN ACT relating to game and fish; establishing residency requirements related to vehicle registration laws for resident hunting and fishing licenses as specified; establishing a violation of residency requirements and vehicle registration laws as specified; providing for penalties; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 23 ‑ 3 ‑ 408 is created to read: 23 ‑ 3 ‑ 408 . Violation of residency requirements and vehicle registration laws ; penalties . ( a ) No person who at the time is disqualified as a resident under W.S. 23 ‑ 1 ‑ 107(k) shall procure, purchase or possess a resident game and fish license, preference point, permit or tag as provided for in this act. (b ) No person who becomes disqualified as a resident under W.S. 23 ‑ 1 ‑ 107(k) shall use a resident game and fish license, preference point, permit or tag as provided for in this act. (c) A first violation of subsection (a) or (b) of this section constitutes a low misdemeanor punishable as provided in W.S. 23 ‑ 6 ‑ 202( a)(v). A second or subsequent violation of subsection (a) or (b) of this section constitutes a high misdemeanor punishable as provided in W.S. 23 ‑ 6 ‑ 202( a)(ii). Section 2 . W.S. 23 ‑ 1 ‑ 107 by creating a new subsection (k) is amended to read: 23 ‑ 1 ‑ 107 . Residency for obtaining game and fish licenses. ( k ) No person required to register a vehicle in Wyoming under W.S. 31 ‑ 2 ‑ 201 shall be deemed a resident under this section who, during the year in which he claims residency r egisters in another state or country a vehicle which will be operated or driven upon any highway in Wyoming in violation of W.S. 31 ‑ 2 ‑ 201 . Section 3 . This act is effective July 1, 2016. (END) 1 HB0112
