Subject: Public assis tance and POWER eligibility requirements Summary/Major Elements: This act requires recipients of public assistance and social services to notify the Department of Family S ervices within ten days upon gaining any property, income or other assets. Previously, recipients were required to give noti ce immediately. This act increases from one to two t he number of vehicles the D epartment may exempt in making eligibility determinations for the Personal Opportunities with Employment R esponsibilities Program (POWER). This act increases from $ 2 , 5 00 to $5 ,0 00 the amount of assets that may be excluded from POWER benefit and eligibility requirements. ORIGINAL House Bill No . HB0114 ENROLLED ACT NO. 43, HOUSE OF REPRESENTATIVES SIXTY-THIRD LEGISLATURE OF THE STATE OF WYOMING 2016 Budget Session AN ACT relating to the personal opportunity with employment responsibilities (POWER) program; amending asset reporting requirements; amending allowable asset limitations; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 42 ‑ 2 ‑ 109(b) and 42 ‑ 2 ‑ 202(d)(v) are amended to read: 42 ‑ 2 ‑ 109 . Review of assistance and services; termination or modification; notice to department of change in assets. (b) Upon gaining possession of any property, income or other resources assets after receiving any public assistance and social services under this article, a recipient shall immediately notify the department as he becomes not later than ten (10) calendar days after becoming aware of the change in circumstances. The amount of public assistance and social services provided to the recipient shall be accordingly terminated or modified pursuant to rule and regulation of the department. The department shall allow the exclusion of one (1) duly registered and licensed motor vehicle exempt no t more than two (2) licensed motor vehicles from personal resources assets in determining eligibility for any household under the personal opportunities with employment responsibilities (POWER) and supplemental nutrition assistance programs. Married couples shall be allowed a second duly registered and licensed motor vehicle program . 42 ‑ 2 ‑ 202 . Participation required; exemptions; disqualification of benefits. (d) Benefits and eligibility requirements under the personal opportunities with employment responsibilities (POWER) program shall be modified for assistance units under subsection (c) of this section as follows: (v) Excluding allowance for personal motor vehicles as specified under W.S. 42 ‑ 2 ‑ 109(b), the amount of resources assets an assistance unit may own shall be two thousand five hundred dollars ($2,500.00) no t greater than five thousand dollars ($5,000.00) . Section 2 . This act is effective July 1, 201 6 .
