Essential and emergency medication task force.

A BILL

for

AN ACT relating to the administration of government; creating the Wyoming school essential and emergency medication task force; requiring the task force to study and make recommendations on the management and administration of diabetes medication and other essential medications in schools as specified; specifying task force membership and staffing; providing additional duties to the department of health; requiring a report; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1.

(a)

The governor shall appoint a
task force known as the Wyoming school essential and emergency medication task force consisting of the following members:

(i)

One (1) representative from the Wyoming state board of nursing;

(
ii
)

One (1) representative from the department of health;

(
iii
)

One (1) member of a Wyoming school district board of trustees;

(
iv
)

One (1) member of the public who is a parent of a
Wyoming student
diagnosed
with diabetes;

(v)

One (1) certified, registered or licensed health care professional with expertise in diabetes.

(b)

The governor shall appoint the chairman of the task force.

(
c
)

The task force shall study and make recommendations concerning:

(i)

The authori
ty of
a school district board to adopt and implement a policy aimed at managing students' diabetes medication
and other essential and emergency medications
in school
;

(ii)

The appropriate school personnel who should be responsible for administering diabetes medication and other essential and emergency medication
s
to students
in school
;

(iii)

Immunity of school districts for damages for any injuries that result from the administration
of
,
or failure to administer
,
diabetes medication or other essential or emergency medication
s
to students;

(iv)

Education
and training for school personnel on the management and administration of diabetes medication and other essential and emergency medications in schools;

(v)

Other issues the task force
determines to be relevant to th
e
study.

(d)

The task force shall regularly provide updates to the joint labor, health and social services interim committee. The task force shall submit a
report summarizing its studies and recommendations
with respect to the issues specified in subsection (c) of this section to the joint labor, health and social services interim committee and the governor no later than September 1, 2016. The joint labor, health and social services interim committee shall consider the recommendations and develop legislation it deems appropriate for consideration by the legislature.

(e)

Service on the task force by task force members who are government employees shall be considered part of the member's regular employment
duties
. Task force members who are members of the public shall serve without compensation.

(f)

The department of health shall provide an executive secretary to the task force and shall provide staff and other support to the task force as required
to fulfill
its duties under this act. State agencies shall provide information and assistance to the task force as requested.

(g)

The task force shall terminate
December 31

.

Section 2
.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
