Subject: P ermissive private employment preference for veterans and spouse s Summary/Major Elements: Under current Wyoming law, public employers are authorized to grant employment preference to veterans, subject to conditions specified by statute. This act specifies private employer s may grant employment preference to a veteran or to the spouse of a disabled or dec eased veteran. The act specifies granting an employment preference does not violate local or state equal employment opportunity laws. ORIGINAL Senate ENGROSSED File No . SF0003 ENROLLED ACT NO. 63, SENATE SIXTY-THIRD LEGISLATURE OF THE STATE OF WYOMING 2016 Budget Session AN ACT relating to veterans; providing for permissive private employer hiring preference for veterans and spouses of disabled and deceased veterans; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 19 ‑ 14 ‑ 111 is created to read: 19 ‑ 14 ‑ 111 . Employment; permissive preference in private employment . (a ) A private employer may grant preference to a veteran in hiring and prom otion. ( b ) A private employer may grant preference in hiring and promotion to a spouse of a disabled veteran and to a surviving spouse of a deceased veteran. (c) The granting of a preference based on a person's status under subsection (a) or (b) of this section shall not be considered a discriminatory or unfair employment practice under local or state equal employment opportunity law, provided the granting of the preference is not based in any manner on consideration of a characteristic, attribute or category enumerated in state law as constituting a discriminatory or unfair employment practice. (d) As used in this section: (i) " D isabled veteran" means a veteran who has a compensable service connected permanent and total disability certified by the United States veterans administration or by the retirement board of one (1) of the several branches of the armed forces ; (ii) "Veteran" means a member of the military forces of the United States whose written evidence of separation from the military forces shows an honorable discharge or the rendition of honorable military service. Section 2 . This act is effective July 1, 201 6 .
