SIXTY-FOUR LEGISLATURE OF THE STATE OF WYOMING
2016 Budget Session

AN ACT relating to highway, bicycle and pedestrian safety; creating a task force to study the benefits and opportunities of bicycle and pedestrian pathways and natural surface trails in the state; specifying task force membership and staffing; providing additional duties to the Wyoming business council; requiring reports; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1
.

Bicycle
AND PEDESTRIAN
system task force

(a)

The
governor
shall
appoint
a bicycle
and pedestrian
system task force

of
thirteen
(1
3
)
members subject to the following:

(i)

O
ne (1) member shall be a department of transportation employee knowledgeable in highway safety;

(ii)

O
ne (1) member shall be a
representative of
local
government
;

(
i
ii
)

O
ne (1) member shall be an employee of the office of tourism or a member of the Wyoming tourism board;

(
i
v)

O
ne
(1) member shall be active in a
bicycle
tourism related business;

(
v
)

Two (2)
member
s
shall be
representative
s
of local or statewide bicycle group
s
;

(
vi
)

O
ne (1) member shall be a member
or
an
employee
of the Wyoming business council;

(
vi
i
)

O
ne (1) member shall be the state epidemiologist
or other employee of the department of health
;

(viii)

One (1) member shall be a department of state parks and cultural resources employee knowledgeable in natural surface trail systems;

(ix)

One (1) member shall be familiar with equestrian activities;

(x)

One (1) member shall be a department of transportation employee or other qualified representative knowledgeable in planning, designing and constructing bicycle and pedestrian pathways

One (1) member shall be from the agriculture industry;

(
xii
)

One (1) member shall be from the trucking industry.

(b)

The governor shall appoint the chairman of the task force.

(
c
)

The task force shall:

(i)

Develop a
report to help the department of transportation
, department of state parks and cultural resources, department of health,
office of tourism,
Wyoming business council
and local communities better understand the opportunities and challenges of bicycle
and pedestrian
pathways. In developing the report the task force shall:

(A)

Consider the health benefits to Wyoming residents of encouraging bicycle and pedestrian recreation
and transportation
and ways in which these benefits can be attained;

)

Consider opportunities
for using bicycle
and pedestrian
pathways
and natural surface trails
to benefit economic development through enhanced tourism opportunities and
community enhancements
;

(
C
)

Identify and evaluate options to fund
the construction and maintenance of
bicycle
and pedestrian
pathways
and natural surface trails
for state and local governments
, including funding from private individuals, corporate funding, grants from nonprofit organizations and local, state and federal sources
;

(
D
)

Consider safety analys
e
s
relating to
fatalities and serious injury accidents involving motor vehicles
and
bicycles
and pedestrians
in Wyoming
and
safety concerns raised by the analys
e
s;

(
E
)

Consider and make recommendations on the various ways the state can
coordinate with and assist
efforts to develop local
and
state
bicycle
and pedestrian
pathways
and natural surface trails
;

(
F
)

Consider the extent to which bicycle
and pedestrian
pathways
and natural surface trails
should be available to people riding horses;

(
G
)

C
onsider the
most cost effective method of construction of bicycle
and pedestrian
pathways along
public
roads
;

(
H
)

Consider effective methods of construction of natural surface trails
;

(
J
)

Include any other considerations as the task force may deem appropriate.

(ii)

Submit a preliminary report on or before October 1, 2016 and a final report on or before October 1, 2017 with respect to the issues specified in paragraph (i) of this subsection to the transportation commission, tourism board, Wyoming business council, the joint travel, recreation and wildlife interim committee and the joint transportation, highways and military affairs interim committee.

)

Service on the task force by task force members who are government employees shall be considered part of the member's regular government employment. Task force members who are members of the public shall serve without compensation.

e)

The
Wyoming business council
shall provide an executive secretary to the task force and shall provide staff
and other
support to the task force
as required
to fulfill
its duties under this act
.

(f)

All meetings of the task force shall be conducted as public meetings pursuant to W.S. 16

‑
408. To the extent practicable, the task force shall take reasonable efforts to make its meetings electronically available to the public.

g
)

The task force shall terminate July 1, 2018.

.

This
act is effective
immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
