Subj ect: Clarifying the date upon which a request for hearing on a worker’ s compe nsation benefit denial is filed Summary/Major Elements: This bill clarifies when a requesting for a hearing on a denial of worker’ s compensation benefits is filed. The bill cla rifies that the Wyoming Statute s ’ general provision concerning when a document is filed is applicable. The general provision is located at W.S. 16-4-301(a) and provides, among other things, that a filing by mail is considered filed on the date of the postmark. ORIGINAL Senate File No . SF0089 ENROLLED ACT NO. 21, SENATE SIXTY-THIRD LEGISLATURE OF THE STATE OF WYOMING 2016 Budget Session AN ACT relating to labor and employment; clarifying the deadline for requesting a hearing on a final determination of worker's compensation benefits by specifying applicable law; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 27 ‑ 14 ‑ 601( k)(iv) is amended to read: 27 ‑ 14 ‑ 601 . Payment or denial of claim by division; notice; objections; review and settlement of claims; filing fee; preauthorization of hospitalization or surgery . (k) Determinations by the division pursuant to this section and W.S. 27 ‑ 14 ‑ 605 shall be in accordance with the following: (iv) Any interested party may request a hearing before a hearing examiner on the final determination of the division by filing a written request for hearing with the division within fifteen (15) days after the date the notice of the final determination was mailed by the division. If the division has not rendered a final determination within sixty (60) days following the date the claim was filed, any interested party may request a hearing before a hearing examiner in the manner prescribed by this paragraph. If the written request for hearing is sent to the division by certified or registered mail, postage prepaid, return receipt requested, proof of such mailing within the time provided by this subsection with a receipt signed by an agent of the state of Wyoming shall be presumed to be timely filing of the request with the divisio n The date a written request for hearing is filed shall be determined pursuant to W.S. 16 ‑ 4 ‑ 301( a) ; Section 2 . This act is effective July 1, 201 6 .
