Subject: Creation of a task force to review facility needs at the Wyoming State P e nitentiary at Rawlins, Wyoming Summary/Major Elements: This act: Establishes a task force to study issues related to facility defects at the Wyoming S tate P enitentiary (P enitentiary ) at Rawlins, Wyoming , and inmate housing issues . The act provides the review will include the feasibility of repairing or adding to the P enitentiary and relocation of all , or a portion of, the penitentiary population to an existing or new facility in another location in the state. Provides the task force will be comprised of five members from the House of Representative s and five members from the Senate , to be appointed by the Speaker of the House and the President of the Senate , respectively. The act requires one member from each house be from the minority party . In addition , the task force will include three members appointed by the Governor and provides the task force will expire December 31, 2016. Provides the Legislative Servic e Office (LSO) will staff the task force and appropriates funds to the LSO and the Governor for the expenses of the task force members. Requires the task force report findings to the Joint Appropriations Committee and the Joint Judiciary Interim Committee not later than October 1, 2016 , and further provides the two committees may introduce legislation in the 2017 General S ession as d eemed appropriate to address facility issues. ORIGINAL Senate ENGROSSED File No . SF0091 ENROLLED ACT NO. 54, SENATE SIXTY-THIRD LEGISLATURE OF THE STATE OF WYOMING 2016 Budget Session AN ACT relating to state institutions; creating a task force to review potential penitentiary construction needs; providing for membership, requirements for task force study and report; providing for staffing and for assistance by state agencies; providing appropriations; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. (a) There is created the task force on state penal facilities to study issues relating to building defects at the Wyoming state penitentiary at Rawlins, Wyoming and associated inmate housing issues . The task force shall consist of: ( i ) Five (5) members of the Wyoming senate to be appointed by the president of the senate . At least one (1) member shall be from the minority party ; ( ii ) Five (5) members of the Wyoming house of representatives to be appointed by the speaker of the house . At least one (1) member shall be from the minority party ; ( iii ) Three (3) members appointed by the governor not later than March 31, 2016. Two (2) of the members shall be members of the public who reside in communities with penitentiary institutions and one (1) shall be an engineer with knowledge of construction. (b ) The cochairmen of the task force shall be appointed by the president of the senate and the speaker of the house, respectively. (c ) The legislative service office shall staff the task force . State agencies shall provide information and assistance to the task force as requested. ( d ) The task force shall study a nd make recommendations for solutions related to building deficiencies at the Wyoming state penitentiary in Rawlins and associated inmate housing issues. The task force shall review the feasibility of repair ing or adding to the current penitentiary, construction of a new penitentiary in Rawlins , and relocation of all or a portion of the penitentiary population to an existing or new facility in an other location in the state. The task force shall consider existing and future projected inmate populations, capacity of communities and the department of correct ions to adequately staff facilit ies , cost s of repair and new construction, expected life cycles, timeframes , alternatives to incarceration and other items as the committee determines prudent to adequately address the issues under study. (e ) The task force shall report its findings to the joint appropriations committee and the joint judiciary interim committee not later than October 1, 2016. The joint appropriations committee and joint judiciary interim committee may introduce legislation in the 2017 general session as each determine s appropriate to address issues studied pursuant to this act . (f ) The task force shall terminate December 31, 201 6 . Members of the task force who are not state employees, town officers or legislators shall not receive a salary but shall receive reimbursement for mileage and per diem expenses at a rate provided for legislators under W.S. 28 ‑ 5 ‑ 101. Section 2 . (a) T here is appropriated from the penitentiary permanent land fund to the legislative service office seventy thousand dollars ($ 7 0 ,00 0 .00) for purposes of this act. (b) There is appropriated from the penitentiary permanent land fund to the governor's office two thousand one hundred eighty dollars ($2,180.00) for payment of authorized per diem and mileage for task force members who are not state employees, town officers or legislators. Section 3 . This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
