Subject: Creation, continuance and reauthorization of at-will employee contract positions Summary/Major Elements: In addition to full-time and part-time state employees, state agencies may utilize at-will contract employees to meet programmatic needs. On occasion, the Governor may create an at-will employee contract position when the Legislature is not in session. This bill applies to these occasions. Th e bill specifies that no at-will employee contract position shall be created unless specifically authorized by legislation or approved by the Governor. The bill requires legislative review and approval for continuance of an at-will employ ee contract position created by the Governor. The bill specifies an at-will employee contract position shall terminate if not specifically approved by the Legislature and shall not be reauthorized in the future without prior legislative approval. ORIGINAL Senate File No . SF0103 ENROLLED ACT NO. 9, SENATE SIXTY-FOUR LEGISLATURE OF THE STATE OF WYOMING 2016 Budget Session AN ACT relating to administration of government; providing for the creation of at-will employment contract positions by the legislature and the governor; requiring legislative approval for continuance of an at-will employment contract position created by the governor as specified; requiring legislative approval prior to the reauthorization of a denied at-will employment position; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 9 ‑ 2 ‑ 1012 by creating a new subsection (h) and 9 ‑ 2 ‑ 1022( a)(xi)(F) (V) and by creating a new subdivision (VI) are amended to read: 9 ‑ 2 ‑ 1012 . Duties of budget division; transmittal of standard budget and manual; return of completed exception and expanded budgets; submission to governor; disposition of excess general fund appropriations; submission of selected budget information to joint appropriations interim committee. (h) If the governor exercises his authority provided by W.S. 9 ‑ 2 ‑ 1022( a)(xi)(F)(VI) to create an at ‑ will employment contract position, the governor shall seek continued authorization for that position by a budget request in the next session of the legislature. If authorization for the at ‑ will employee contract position is not specifically approved in the general appropriations bill , the position shall terminate and shall not be reauthorized in the future without prior legislative approval. 9 ‑ 2 ‑ 1022 . Duties of department performed through human resources division. (a) Subject to subsection (b) of this section, the department through the human resources division shall: (xi) Promulgate reasonable rules: (F) Necessary to administer a program whereby at ‑ will contr act employees may be utilized by agencies to meet programmatic needs. These rules shall be structured so that: (V) An at ‑ will contract shall be for a term not exceeding twenty ‑ four (24) months subject to renewal of the contract at the end of the contract period and W.S. 9 ‑ 2 ‑ 1012( h) ; (VI) No at ‑ will employee contract position shall be created unless specifically authorized by legislation or approved by the governor. Any position approved by the governor shall be reported to the joint appropriations committee as provided by W.S. 9 ‑ 2 ‑ 1005( b). Continued a uthorization of any at ‑ will employee contract position created by the governor shall be subject to legislative review and approval pursuant to W.S. 9 ‑ 2 ‑ 1012( h). Section 2 . This act is effective July 1, 2016 .
