A JOINT RESOLUTION

for

A JOINT RESOLUTION proposing to amend the Wyoming Constitution to provide for a right of individual privacy which shall not be construed to deprive a person of any right provided by law to examine documents or to observe the deliberations of any agency or political subdivision of the state, except in cases in which the demand of individual privacy clearly exceeds the merits of public disclosure.

BE
IT RESOLVED BY THE LEGISLATURE OF THE STATE OF WYOMING,
two-thirds of all the members of the two houses, voting separately, concurring therein:

Section 1.
The following proposal to amend Wyoming Constitution, Article
1
,
by creating a new
Section
40
is proposed for submission to the electors of the State of
Wyoming at the next general election for approval or rejection to become valid as a part of the Constitution if ratified by a majority of the electors at the election:

Article 1, Section 40.

Right of privacy

The right of individual privacy is essential to the well-being of a free society and shall not be infringed without the showing of a compelling state interest.

N
othing in this section shall be construed to deprive a person
of
any right provided by law to
examine documents or to observe the deliberations of
any agency or political subdivision
of the state
, except in cases in which the demand of individual privacy clearly exceeds t
he merits of public disclosure.

Section 2.
That the Secretary of State shall endorse the following statement on the proposed amendment:

The adoption of this amendment will provide that t
he right of individual privacy is essential to the well-being of a free society and shall not be infringed without the showing
of a compelling state interest.
This amendment will not deprive a person
of
any right provided by law
to examine documents or to observe the deliberations of
any agency or political subdivision of
the state
, except in cases in which the demand of individual privacy clearly exceeds the merits of public disclosure.
