Subject: Requiring the judicial branch to submit budget r e quests to the Legislature in a similar manner to executive branch a gencies. Summary/Major Elements: Prior to the 2017 General Session, provisions in previously enacted General Appropriations Bills required the judicial branch to submit budget request s to the Legislature in a manner similar to executive branch agencies. This bill places this requirement i nto Wyoming Stat utes. This act r e quires the Supreme Court, on behalf of itself and the Circuit Courts, to submit standard and supplemental budget requests to the Legislature not later than November 1 of the year preceding the fiscal year in which the standard or supplemental budget is to take effect. The act r equires the same of each District Court for its budget. The act r equires the courts to prepare the personal services budget requests using the same methods and practices as the executive branch. ORIGINAL House Bill No . HB0045 ENROLLED ACT NO. 16, HOUSE OF REPRESENTATIVES SIXTY-FOURTH LEGISLATURE OF THE STATE OF WYOMING 2017 General Session AN ACT relating to courts; providing budget procedures for the judicial branch; providing for the submittal of budgets of the judicial branch to the legislature; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 5 ‑ 2 ‑ 123 and 5 ‑ 3 ‑ 113 are created to read: 5 ‑ 2 ‑ 123 . Supreme court budget submittal. The supreme court shall submit standard and supplemental budget requests to the legislature not later than November 1 of the year preceding the fiscal year in which the standard or supplemental budget is to take effect. The supreme court shall prepare all personal services budget requests using the same methods and practices as the executive branch. 5 ‑ 3 ‑ 113 . District courts budget submittal. All district courts shall submit standard and supplemental budget requests to the legislature not later than November 1 of the year preceding the fiscal year in which the standard or supplemental budget is to take effect. The district courts shall prepare all personal services budget requests using the same methods and practices as the executive branch. Section 2 . W.S. 5 ‑ 9 ‑ 122 is amended to read: 5 ‑ 9 ‑ 122 . Budget. The supreme court shall submit one (1) budget for the operation of all circuit courts, itemized by circuit, to the legislature for appropriation for each biennial period using forms and following procedures provided by law for state agencies funded by legislative appropriation. The supreme court shall submit the circuit courts ' budget in the same manner as provided for the supreme court budget in W.S. 5 ‑ 2 ‑ 123. Section 3 . This act is effective July 1, 201 7 .
