2017 STATE OF WYOMING 17LSO-0465 Introduced 1.2 HOUSE BILL NO. HB0118 Purchase of water rights and facilities. Sponsored by: Select Water Committee A BILL for AN ACT relating to water; authorizing negotiations to purchase existing water rights and facilities associated with water storage capacity in Lake DeSmet, Healy Reservoir and associated diversion structures, pumping facilities and transmission pipelines; describing the project; specifying terms and conditions of negotiations; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. (a) The Wyoming water development office, in consultation with the state engineer, is authorized to negotiate a contract for the purchase of existing water rights and storage capacity in Lake DeSmet Reservoir and Healy Reservoir, totaling up to sixty ‑ eight thousand (68,000) acre feet of storage, all related and existing reservoir supply water rights and all associated facilities including diversion structures, pumping facilities, transmission pipelines and other appurtenances necessary for the beneficial use of the water under those existing rights. The negotiated contract shall not exceed a proposed maximum purchase price of four million five hundred thousand dollars ($4,500,000.00). (b) The Wyoming water development office shall submit any contract negotiated under this section to the Wyoming water deve lopment commission and governor for approval . The contract shall be contingen t on legislative appropriation of the funds required for the purchase . Section 2 . This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution. (END) 1 HB0118
