Subject: Disclosure of t rust documents in trust-related judicial proceedings. Summary/Major Elements: Th is bill amends the Wyoming Uniform Trust Code by creating provisions regarding the sealing and availability of trust documents in trust-related judicial proceedings. The bill requires that , upon the filing of a petition, specified trust documents and any court order thereon must be sealed and not made a part of the proceeding's public record . Upon seal ing , the documents must still be available to the court, the settlor, any fiduciary, any q ualifi ed beneficiary, their attorneys and any other interested person as the court may order upon a showing of need. ORIGINAL House Bill No . HB0125 ENROLLED ACT NO. 20, HOUSE OF REPRESENTATIVES SIXTY-FOURTH LEGISLATURE OF THE STATE OF WYOMING 2017 General Session AN ACT relating to the Uniform Trust Code; providing for the sealing of trust documents in judicial proceedings as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 4 ‑ 10 ‑ 205 is created to read: 4 ‑ 10 ‑ 205 . Sealing and availability of documents. The privacy of those who have established a trust shall be protected in any judicial proceeding concerning the trust. Upon the filing of any petition, the trust instrument, inventory, statement filed by any fiduciary, annual verified report of a fiduciary, final report of a fiduciary and any petition relevant to trust administration and any court order thereon shall be sealed and shall not be made a part of the publ ic record of the proceeding, but shall be available to the court, the settlor , any fiduciar y, any qualified beneficiary, their attorney s , and any other interested person as the court may order upon a showing of need. Section 2 . This act is effective July 1, 201 7 .
