Subject: Disposition of lottery proceeds. Summary/Major Elements: Existing law provides until June 30, 2022, the first six million dollars ($6,000,000.00) in each fiscal year of net proceeds from the sale of lottery tickets deposited with the State Treasurer shall be paid to counties, cities and towns. Net proceeds in excess of six million dollars ($6,000,000.00) shall be paid to the common school account within the permanent land fund. This act repeals the requirement that net proceeds in excess of six million dollars ($6,000,000.00) be deposited in the common school a ccount and instead provides at least once per fiscal year, all net proceeds from the sale of lottery tickets deposited with the State Treasurer shall be paid to counties, cities and towns. Existing law provides a computation for determining the percentage of such net proceeds that will be distributed to each county. The computation compares the net sales taxes collected attributable to vendors in each county to the total net sales taxes collected of vendors in all counties. This act modifies that computation and compares the sales of lottery tickets collected by vendors in each county to the sales of lottery tickets collected by vendors in all counties. ORIGINAL House ENGROSSED Bill No . HB0131 ENROLLED ACT NO. 114, HOUSE OF REPRESENTATIVES SIXTY-FOURTH LEGISLATURE OF THE STATE OF WYOMING 2017 General Session AN ACT relating to the Wyoming lottery; modifying disposition of lottery proceeds as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 9 ‑ 17 ‑ 111( b)(intro) is amended to read: 9 ‑ 17 ‑ 111 . Disposition of lottery proceeds. (b) On or before the fifteenth day of each quarter, the corporation shall transfer to the treasurer's office, for credit to the lottery account which is hereby created, the amount of all net proceeds minus prizes and amounts earned pursuant to subsection (a) of this section during the preceding quarter. Upon their deposit into the account, any monies representing a deposit of net proceeds shall then become the unencumbered property of the state of Wyoming and the corporation shall have no power to agree or undertake otherwise. Until June 30, 2022, the first six million dollars ($6,000,000.00) in each fiscal year of At least once per fiscal year , these monies shall be paid by the treasurer as they accrue to the treasurers of the counties, cities and towns for payment into their respective general funds. The percentage of the balance that will be distributed to each county and its cities and towns will be determined by computing the percentage that net sales taxes collected attributable to vendors as defined in W.S. 39 ‑ 15 ‑ 101(a)(xv) sales of lottery tickets collected by retailers in each county including its cities and towns bear to total net sales taxes collected of vendors as defined in W.S. 39 ‑ 15 ‑ 101(a)(xv) sales of lottery tickets collected by retailers in all counties including their cities and towns. This percentage of the monies shall be distributed within each county as follows: Section 2 . W.S. 9 ‑ 17 ‑ 111(c) is repealed. Section 3 . This act is effective July 1, 201 7 .
