Sponsored by: Representative(s) Walters and Senator(s) Wasserburger A BILL for AN ACT relating to public health and safety; requiring the department of health to develop and implement statewide tobacco prevention, cessation and treatment programs and provide materials as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 9 ‑ 2 ‑ 102 ( a) by creating a new paragraph ( vi ) and 9 ‑ 4 ‑ 1204(a) are amended to read: 9 ‑ 2 ‑ 102 . Department of health; duties and responsibilities; state grants. (a) The department of health is the state mental health authority, the developmental disabilities authority and the substance abuse authority. The department through its divisions has the following duties and responsibilities to: ( vi ) D evelop and implement comprehensive tobacco prevention, cessation and treatment programs for Wyoming, as provided in W.S. 9 ‑ 4 ‑ 1204. 9 ‑ 4 ‑ 1204 . Tobacco settlement funds; reduction of tobacco use. (a) Using a science and experience based approach, the department of health shall develop and implement The comprehensive tobacco prevention, cessation and treatment programs for Wyoming. These programs the department of health develop s pursuant to W.S. 9 ‑ 2 ‑ 102(a)(vi) shall include peer reviewed science based educational materials on tobacco harm reduction and the comparative risks of alternative nicotine products, vapor products, smokeless tobacco products, cigarettes and other combustible tobacco products. The program should be tailored to provide the most cost effective reduction of tobacco related problems based on available funds for each year. The department shall provide all adult consumers of tobacco products seeking information on tobacco cessation and minors consenting to health care under W.S. 14 ‑ 1 ‑ 101(b)(vi) with materials on tobacco harm reduction and the comparative risks of alternative nicotine products, vapor products, smokeless tobacco products, cigarettes and other combustible tobacco products. Section 2 . This act is effective July 1, 201 7 . (END) 1 HB0148
