Subject: Amending residency requirements for granting of a divorce . Summary/Major Elements: Curr ently, Wyoming law requires the plaintiff in a divorce proceeding to either (1) reside in Wyoming for sixty (60) days prior to t he filing of the divorce action, or (2) to have continually resided in Wyoming from the time the marriage was solemnized if the marriage was solemnized in Wyoming. This act ame nds the residency requirement to allow for the granting of a divorce if either party , the plaintiff or defendant, meets these criteria . ORIGINAL House Bill No . HB0161 ENROLLED ACT NO. 78, HOUSE OF REPRESENTATIVES SIXTY-FOURTH LEGISLATURE OF THE STATE OF WYOMING 2017 General Session AN ACT relating to domestic relations; modifying residency requirements for the granting of a divorce as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 20 ‑ 2 ‑ 107( a) is amended to read: 20 ‑ 2 ‑ 107 . Residential requirements generally for divorce. (a) No divorce shall be granted unless the plaintiff one of the parties has resided in this state for sixty (60) days immediately preceding the time of filing the complaint, or the marriage was solemnized in this state and the plaintiff one of the parties has resided in this state from the time of the marriage until the filing of the complaint. Section 2 . This act is effective July 1, 2017 .
