Summary/Major Elements: This bill requires a physician performing an abortion , a referring physician or their designee s to inform patient s of the opportunity to view an active ultrasound image and hear the fetal heartbeat . Th e requirement s impose d by this bill are not required in cases of medical emergencies or for procedures performed to: Save the life of the patient ; Ameliorate a serious risk of impairment of a major bodily function ; Preserve the live of the unborn child; or Remove a dead unborn child or an ectopic pregnancy. ORIGINAL House ENGROSSED Bill No . HB0182 ENROLLED ACT NO. 90, HOUSE OF REPRESENTATIVES SIXTY-FOURTH LEGISLATURE OF THE STATE OF WYOMING 2017 General Session AN ACT relating to public health and safety; requiring physicians to provide patients with specified information before certain nonemergency abortion procedures; providing exceptions; providing and amending definitions; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 35 ‑ 6 ‑ 119 is created to read: 35 ‑ 6 ‑ 119 . Information provided to patient ; exceptions; penalty . (a) Except in the case of a medical emergency, the physician performing the abortion on the patient , the referring physician or a person designated by either physician shall inform the patient of the opportunity to view an active ultrasound of the unborn child and hear the heartbeat of the unborn child if the heartbeat is audible. The active ultrasound image and auscultation of fetal heart tone shall be of a quality consistent with standard medical practice in the community. ( b ) This section shall not apply to a procedure performed with the intent to: ( i ) Save the life of the patient; (ii) Ameliorate a serious risk of causing the patient substantial and irreversible impairment of a major bodily function; (iii) Preserve the health of the unborn child; (iv) Remove a dead unborn child; or (v) Remove an ectopic pregnancy. Section 2 . W.S. 35 ‑ 6 ‑ 101( a)(xii) is amended to read: 35 ‑ 6 ‑ 101 . Definitions. (a) As used in the act, unless the context otherwise requires: (xii) "This act" means W.S. 35 ‑ 6 ‑ 101 through 35 ‑ 6 ‑ 118 35 ‑ 6 ‑ 119 . Section 3 . This act is effective July 1, 201 7 .
