(
a
)

The following shall apply to
pipeline easements across land executed and recorded
on or
after
July 1, 2017
:

(i)

If the easement is silent or unclear regarding the width of the easement,
the easement
shall be limited to
no more than
fifty (50) feet
wide
;

(
ii
)

If the easement is silent or unclear on t
he number of pipelines to be installed or allow
s
for
the installation of
an unlimited number of pipelines without
specifying
a timeframe for installation,
the easement

shall be limited to the number of pipelines installed within five
(5)
years
after
the date the easement
was executed
.

(
b
)

T
he following shall apply to pipeline easements across land executed and recorded
prior to
July 1, 2017:

(i)

I
f the easement is silent or unclear regarding the width of the easement,
the easement
shall be limited to no more than fifty (50) feet wide if there is one

completed pipeline in the easement and no more than one hundred (100) feet wide if
there
are multiple
completed pipeline
s
in the easement

and the completed pipelines do not exceed one hundred (100) feet in width

ii
)

I
f the easement is silent or unclear on the number of pipelines to be installed or allows for the installation of an unlimited number of pipelines without specifying a timeframe for installation, it shall be limited to the number of pipelines installed
prior to July 1, 2022
.

(c)

Nothing in this section shall
prevent
parties from executing and recording easements with terms that conflict with this section. The specific provisions of an easement are effective and controlling to the extent they conflict with
the requirements of
this section.
