Sponsored by: Representative(s) Henderson and Senator(s) Meier A BILL for AN ACT relating to utilities; requiring cities, towns, improvement and service districts, public utilities, and water and sewer districts to provide notice of a past due account to property owners; making a conforming amendment; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 15 ‑ 7 ‑ 115, 18 ‑ 12 ‑ 141, 37 ‑ 3 ‑ 116 and 41 ‑ 10 ‑ 158 are created to read: 15 ‑ 7 ‑ 115 . Notice to property owner of a past due municipal account. To provide a property owner with information regarding the owner's property only, a city or town shall ensure that notice is provided to the property owner of record of a past due m unicipal water, sewer, electric, trash or recycling account. One (1) notice shall be sent when an account has been past due for thirty (30) days and one (1) notice shall be sent when an account has been past due for sixty (60) days. Notices required by this section shall be sent to the record owners by first class mail or electronic mail to the record owners' addresses on file with the city or town. Notices required by this section shall be in addition to any notices sent to an account holder. Each city or town shall adopt appropriate policies to implement this section. 18 ‑ 12 ‑ 141 . Notice to property owner of a past due trash or recycling account. To provide a property owner with information regarding the owner's property only, a district shall ensure that notice is provided to a property owner of record of a past due water, sewer, trash or recycling account associated with the owner's property. One (1) notice shall be sent when an account has been past due for thirty (30) days and one (1) notice shall be sent when an account has been past due for sixty (60) days. Notices required by this section shall be sent to the record owners by first class mail or electronic mail to the record owners' addresses on file with the district . Notices required by this section shall be in addition to any notices sent to an account holder. Each district shall promulgate appropriate rules to implement this section. 37 ‑ 3 ‑ 116 . Notice to property owner of a past due utility account. To provide a property owner with information regarding the owner's property only, a public utility shall provide notice to a property owner of record of a past due account associated with the owner's property. One (1) notice shall be sent when an account has been past due for thirty (30) days and one (1) notice shall be sent when an account has been past due for sixty (60) days. Notices required by this section shall be sent to the record owners by first class mail or electronic mail to the record owners' addresses on file with the utility. Notices required by this section shall be in addition to any notices sent to a utility account holder. The commission shall promulgate appropriate rules to implement this section. 41 ‑ 10 ‑ 158 . Notice to property owner of a past due water or sewer account. To provide a property owner with information regarding the owner's property only, a water district, sewer district or water and sewer district shall ensure that notice is provided to a property owner of record of a past due water or sewer account associated with the owner's property. One (1) notice shall be sent when an account has been past due for thirty (30) days and one (1) notice shall be sent when an account has been past due for sixty (60) days. Notices required by this section shall be sent to the record owners by first class mail or electronic mail to the record owners' addresses on file with the district . Notices required by this section shall be in addition to any notices sent to an account holder. Each water district, sewer district or water and sewer district shall promulgate appropriate rules to implement this section. Section 2 . W.S. 18 ‑ 12 ‑ 102( a)(xi) is amended to read: 18 ‑ 12 ‑ 102 . Definitions. (a) As used in this act: (xi) "This act" means W.S. 18 ‑ 12 ‑ 101 through 18 ‑ 12 ‑ 140 18 ‑ 12 ‑ 141 ; Section 3 .
