Sponsored by: Representative(s) Baker and Halverson A BILL for AN ACT relating to controlled substances; prohibiting the attorney general from adding, deleting or rescheduling controlled substances by emergency rule; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 35 ‑ 7 ‑ 1011( a)(intro) is amended to read: 35 ‑ 7 ‑ 1011 . Control of substances. (a) The commissioner shall administer this act and with the advice of the advisory board established in W.S. 35 ‑ 7 ‑ 1005 may add substances to or delete or reschedule all substances enumerated in the schedules in W.S. 35 ‑ 7 ‑ 1014, 35 ‑ 7 ‑ 1016, 35 ‑ 7 ‑ 1018, 35 ‑ 7 ‑ 1020 and 35 ‑ 7 ‑ 1022 pursuant to the procedures of the Wyoming Administrative Procedure Act , except that no additi on, deletion or rescheduling of substances shall be by emergency rule . In making a determination regarding a substance, the commissioner shall consider the following: Section 2 . This act is effective July 1, 2017 . (END) 1 HB0232
