A BILL

for

AN ACT relating to public indecency; creating the crime of public indecency for using a public bathroom or changing facility designated for the opposite sex; providing exceptions; and providing for an effective date.

Public indecency; exception; penalties.

(a)

A person is guilty of public indecency if, while in a public place where he may reasonably be expected to be viewed by others, he:

(ii)

Exposes his intimate parts, as defined by W.S. 6-2-301(a
)(
ii), with the intent of arousing the sexual desire of himself or another person;
or

(
iii
)

Engages in sexual contact, as defined by W.S. 6

301(a)(vi), with or without consent, with the intent of arousing the sexual desire of himself or another person

or

(iv)

Knowingly

ses
a public
bathroom or changing facility
designated to be used by a specific
sex
which does not correspond to the person's
sex
identified at birth by th

(d)

Paragraph (a
)(
iv) of this section sha
ll not apply to
any person entering a public bathroom
or
changing facility for any one (1) of the following purposes
:

(i)

Maintenance, cleaning or inspection of the bathroom or facility
;

(ii)

To render medical assistance to persons in the bathroom or facility;

(iii)

To accompany a person needing assistance in the use of the bathroom or facility;

(iv)

When
the bathroom or facility has been temporarily designated for use by that person's sex.

Equal enjoyment of public accommodations and facilities; penalties.

(a)

All persons of good deportment are entitled to the full and equal enjoyment of all accommodations, advantages, facilities and privileges of all places or agencies which are public in nature, or which invite the patronage of the public, without any distinction, discrimination or restriction on account of race, religion, color, sex or national origin.
