Sponsored by: Representative(s) Zwonitzer and Senator(s) Von Flatern A BILL for AN ACT relating to property rights and liabilities; amending provisions related to the rights and liabilities associated with the injection of carbon dioxide for geologic sequestration; amending provisions related to the purpose of unitizing geologic sequestration sites; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 34 ‑ 1 ‑ 153 by creating a new subsection (c) and 35 ‑ 11 ‑ 314(b)(i) are amended to read: 34 ‑ 1 ‑ 153 . Ownership of material injected into geologic sequestration sites; liability for holding interests related to a sequestration site or giving consent to allow geologic sequestration activities; liability generally. (c) The rights, benefits, burdens and liabilities associated with the injection of carbon dioxide, and other substances injected incidental to the injection of carbon dioxide, into geologic sequestration sites for the purpose of geologic sequestration shall include the opportunity afforded each owner of pore spac e to utilize that pore space so far as it is reasonably practicable to do so , even though his operations may cause migration of the injected substances into the land of another . 35 ‑ 11 ‑ 314 . Unitization of geologic sequestration sites; purposes; definitions . (b) Except when context otherwise requires or when otherwise defined in this subsecti on, the terms used or defined in W.S. 35 ‑ 11 ‑ 103, shall have the same meaning when used in W.S. 35 ‑ 11 ‑ 314 through 35 ‑ 11 ‑ 317. When used in W.S. 35 ‑ 11 ‑ 314 through 35 ‑ 11 ‑ 317: (i) "Corresponding rights" means the opportunity afforded each owner of pore space to utilize his just and equitable share of the common reservoir so far as it is reasonably practicable to do so, and the right of all pore space owners in a unit area who will be affected by unit operations, either now or in the future, to concurrently share in the economic benefits generated by using the pore space in the unit area. Section 2 . This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution. (END) 1 HB0249
