Subject: Providing SIPA Funds for a Penitentiary Savings Account. Summary/Major Elements: Creates the Penitentiary Savings Fund in the Strategic Investments and Projects Account (SIPA). Starting June 30, 2019 , for FY 2019 and each June 30 thereafter, there is deposited one-half of the funds in the SIPA into the Penitentiary Savings Fund . The deposit of monies into the Penitentiary Savings Fund under this act will cease when the balance of the Penitentiary Savings Fund exceeds $250,000,000. There has been approximately $8 3 ,000,000 of capital gains on the corpus of the Permanent Wyoming Mineral Trust Fund deposited into the SIPA in each fiscal year pursuant to W.S. 9-4-719(q)(i). ORIGINAL House Bill No . HB0262 ENROLLED ACT NO. 19, HOUSE OF REPRESENTATIVES SIXTY-FOURTH LEGISLATURE OF THE STATE OF WYOMING 2017 General Session AN ACT relating to the Wyoming state penitentiary; creating the Wyoming state penitentiary capital construction account within the strategic investments and projects account; directing funds to the account as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 9 ‑ 4 ‑ 220.1 is created to read: 9 ‑ 4 ‑ 220 .1 Wyoming state penitentiary capital construction account; funds deposited to the account. (a) There is created the Wyoming state penitentiary capital construction account within the strategic investments and project s account created by W.S. 9 ‑ 4 ‑ 220 . Funds in the account shall only be expended upon legislative appropriation. All funds within the account shall be invested by the state treasurer and all investment earnings from the account shall be credited to the general fund . (b) Beginning on June 30 , 20 1 9 for fiscal year 20 19 and June 30 of each fiscal year as provided in this subsection , one-half (1/2) of the total fund balance in the strategic investments and project s account, at the end of each fiscal year shall be deposited into the Wyoming state penitentiary capital construction account. The state treasurer shall cease depositing funds into the Wyoming state penitentiary capital construction account pursuant to this subsection when the balance of the account reaches or exceeds two hundred fifty million dollars ($250,000,000.00 ) . Section 2 . This act is effective July 1, 201 7 .
