WORKING DRAFT ORIGINAL House JOINT RESOLUTION . HJ0002 ENROLLED JOINT RESOLUTION NO. 2, HOUSE OF REPRESENTATIVES SIXTY-FOURTH LEGISLATURE OF THE STATE OF WYOMING 2017 General Session A JOINT RESOLUTION petitioning Congress to call a convention to propose amendments to the Constitution of the United States to require a balanced federal budget. WHEREAS, the l egislature of the State of Wyoming is petitioning the Congress of the United States to call a convention to propose amendments to the Constitution of the United States to require a balanced federal budget. NOW, THEREFORE, BE IT RESOLVED BY THE MEMBERS OF THE LEGISLATURE OF THE STATE OF WYOMING: Section 1. That pursuant to Article V of the Constitution of the United States, the l egislature of the State of Wyoming petitions the Congress of the United States of America, at its session, to call a convention of the states limited to proposing an amendment to the Constitution of the United States requiring that in the absence of a national emergency, including, but not limited to, an attack by a foreign nation or terrorist organization within the United States of America, the total of all federal appropriations made by the Congress for any fiscal year may not exceed the total of all estimated federal revenues for that fiscal year, together with any related and appropriate fiscal restraints. Section 2. That this application is to be considered as covering the balanced budget amendment language of the presently outstanding balanced budget applications from other states, including, but not limited to, previously adopted applications from Alabama, Alaska, Arkansas, Colorado, Florida, Georgia, Indiana, Iowa, Kansas, Louisiana, Maryland, Michigan, Mississippi, Missouri, Nebraska, Nevada, New Hampshire, New Mexico, North Carolina, North Dakota, Ohio, Oklahoma, Pennsylvania, South Dakota, Tennessee, Texas, Utah and West Virginia . This application shall be aggregated with those applications for the purpose of attaining the two ‑ thirds (2/3) of states necessary to require C ongress to call a convention for proposing a balanced budget amendment, but shall not be aggregated with any applications on any other subject. Section 3. That this application constitutes a continuing application in accordance with Article V of the Constitution of the United States until the legislatures of at least two ‑ thirds (2/3) of the several states have made applications on the same subject. This application supersedes all previous applications by this legislature on the same subject. Section 4. That the Secretary of State of Wyoming transmit copies of this resolution to the President of the United States, to the President of the Senate and the Speaker of the House of Representatives of the United States Congress, to the Wyoming Congressional Delegation and to the presiding officers of each of the legislative houses in the several states, requesting their cooperation.
