Summary/Major Elements: This bill establishes that neither a franchisee nor a franchisee's employee is an employee of a franchisor for the purposes of the state's unemployment compensation program, worker's compensation program, or other provisions of Title 27 of the Wyoming Statutes. This bill provides exceptions to this rule: If the franchisor and franchisee agree otherwise in writing; and Pursuant to an agreement between the United States Department of Labor and a franchisee. ORIGINAL Senate File No . SF0094 ENROLLED ACT NO. 74, SENATE SIXTY-FOURTH LEGISLATURE OF THE STATE OF WYOMING 2017 General Session AN ACT relating to employment; clarifying the business relationships between franchisors and franchisees and between franchisors and employees of franchisees; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 27 ‑ 1 ‑ 116 is created to read: 27 ‑ 1 ‑ 116 . Business relationship between franchisors and franchisees ; business relations hip between franchisors and employees of franchisees. (a) N either a franchisee nor a franchisee's employee shall be deem ed to be an employee of the franchisor for any purpose under this title , unless otherwise agreed to in writing by the franchisor and the franchisee. (b) This section shall not apply to a voluntary agreement entered into between the United States department of labor and a franchisee. ( c ) As used in this section, "franchisee" and "franchisor" have the same definitions as set out in 16 C.F.R. 436.1. Section 2 . This act is effective July 1, 2017.
