This bill establishes

that
neither a franchisee nor a franchisee's employee is an employee of a franchisor for the purposes of the state's unemployment compensation program, worker's compensation program, or other provisions of Title 27 of the Wyoming Statutes.

This bill provides exceptions to this rule:

If the franchisor and franchisee agree otherwise in writing; and

Pursuant to
an agreement between the United States Department of Labor and a franchisee.

(a)

either a franchisee nor a franchisee's employee shall be deem
ed to be an employee of the
franchisor for any purpose
under this title
, unless otherwise agreed to in writing by the franchisor and the franchisee.

(b)

This section shall not apply to a voluntary agreement entered into between the United States department of labor and a franchisee.

As used in this section, "franchisee" and "franchisor" have the
same definitions as set out in
16 C.F.R. 436.1.
