2017 STATE OF WYOMING 17LSO-0186 ENGROSSED 2.1 SENATE FILE NO. SF0103 Water project repayment. Sponsored by: Senator(s) Meier, Driskill, Hastert, Hicks and Moniz and Representative(s) Blake, McKim and Paxton A BILL for AN ACT relating to water development; providing that the commission shall require repayment of funds expended for water studies as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 41 ‑ 2 ‑ 114 by creating a new subsection (g) is amended to read: 41 ‑ 2 ‑ 114 . Development of water projects; rehabilitation of water projects. (g) If the commission recommends the expenditure of funds for a level I reconnaissance study that is requested by a person who is not a water district or other public entity, the commission , as a condition for providing funding for the study, shall require that the person organize as a water district or other public entity within a specified time following the completion of the study unless the commission determines that the study serves the public interest . If the person does not organize as a water district or other public entity within the time specified by the commission, the commission may require the person to repay some or all of the funds expended for the study, provided that the commission shall give credit for the value of the study to the public. Section 2 . This act is effective July 1, 201 7 . (END) 1 SF0103
