The commission shall authorize by permits and supervise the conduct of all
bingo games and
pull tab game
event

in this state

at a minimum
that:

s shall only be conducted by charitable

nonprofit organizations
that
have been in existence in this state for at least three (3) years
and have been permitted by the commission pursuant to this act
;

(ii)

Bingo cards and tickets and p
ull tab
game
s are sold only on the premises owned or occupied by the charitable
or
nonprofit organization;

event

a charitable
or
nonprofit
organization shall use only volunteers who are bona fide members of the organization or employees or contractors who are paid by the organization to assist in the operation of the
games and
event

Players

pull tab games shall be eighteen (18) years or older
;

At least sixty

five percent (65%) of all gross sales shall be redeemed as winnings each month. The net proceeds after payment of winnings shall be restricted as follows:

No more than forty percent (40%) of net proceeds shall be paid to distributors or manufacturers of supplies or equipme
nt necessary to conduct the event

(B)

he organization shall donate annually
at least

five percent (75%) of the net proceeds remaining after payment for all costs and supplies to a bona fide charitable or benevolent purpose.

Definitions.

(a)

As used in this article:

(iii)

"Gambling" means risking any property for gain contingent in whole or in part upon lot, chance, the operation of a gambling device or the happening or outcome of an event, including a sporting event, over which the person taking a risk has no control, but does not include any of the following:

(D)

Bingo games
conducted, or pull tabs sold, by charitable or nonprofit organizations where the tickets for the bingo are sold only in this state and the
pull tabs are sold only on the premises owned or occupied by the charitable or nonprofit organization provided that:

mutuel commission; officers; director; meetings; quorum; records; licenses generally; effect of financial interest in events.

(a)

The commission shall annually elect from its membership a president and vice
‑
president, and may employ a director who has a working knowledge of pari
‑
mutuel betting
,

and
horse racing
, bingo
games
and pull tab game events
or an executive secretary, or both. The director may be retained on a yearly basis or for the racing season only as determined by the commission. Salary for the director or executive secretary shall be determined by the commission with the consent of the personnel division. The commission may also employ other personnel required to carry out this act.

(d)

Any member of the commission who owns or has any interest, or whose spouse or member of his immediate family has any interest, in an animal participating in a pari
‑
mutuel event

or
who conducts, manufactures, distributes or supplies
bingo games and

pull tab game
events
shall disclose that interest and shall not
participate in any commission decision involving a protest occurring at that pari
‑
mutuel
, bingo
or pull tab game

event.

(e)

The commission shall authorize by permits and supervise the conduct of all events provided for and regulated by this act, and shall make reasonable rules and regulations for the control, supervision and direction of applicants and permittees, including regulations providing for resolving scheduling conflicts and settling disputes between permittees and the supervising, disciplining, suspending, fining and barring from pari
‑
mutuel
, bingo
or pull tab game
events of all persons required to be licensed by this act, and for the holding, conducting and operating of all pari
‑
mutuel
, bingo
or pull tab game

events conducted pursuant to this act. The commission may require that license applicants be fingerprinted for identification purposes as a condition of licensing. The commission shall announce the place, time and duration of pari
‑
mutuel
, bingo
or pull tab game
events for which license or permit fees shall be required and establish reasonable fees for all licenses and permits provided for by this act. The fees
shall be established to ensure that the costs of administering this act are recovered through the total revenues received under this act. The commission shall establish security access safeguards for licensees to use for advance deposit pari
‑
mutuel wagering. The commission shall prohibit advance deposit pari
‑
mutuel advertising that it determines to be deceptive to the public.

(f)

Each permittee, participant and employee of a permittee or participant who is directly involved in the horse racing or pari
‑
mutuel wagering activities
, the bingo games
or the pull tab game
event
s
of the permittee or participant, as defined in commission rule and regulation, shall be licensed by the commission and shall comply with all rules and regulations and all orders issued by the commission. No person shall hold any event with pari
‑
mutuel wagering
, bingo games
or pull tab games
without obtaining a permit.

(n)

In addition to subsection (e) of this section, t
he commission shall adopt rules governing
bingo games and

in a manner that ensures fair and
equitable involvement
and rules of play for
all affected parties
, record keeping and reporting and

pull tab game standards consistent with
guidance from
