WORKING DRAFT ORIGINAL Senate JOINT RESOLUTION NO . SJ0002 ENROLLED JOINT RESOLUTION NO. 1, SENATE SIXTY-FOURTH LEGISLATURE OF THE STATE OF WYOMING 2017 General Session A JOINT RESOLUTION requesting Congress to enact legislation requiring revenues received by the federal government from wind and solar energy developments on lands of the United States be shared equally with the state in which those developments are located. WHEREAS, wind energy development has occurred in Wyoming in recent years and important new wind energy projects are anticipated to be located, in whole or in part, on federal land in the state; and WHEREAS, the federal government receives rents and fees in connection with the rights-of-way it grants for wind and solar energy developments on federal land and those rents and fees are retained by the federal government and not shared with the states; and WHEREAS, fifty percent (50%) of royalties and rents the federal government receives in connection with the production of certain fossil fuels and geothermal energy on federal land are currently shared with the states pursuant to 30 U.S.C. § 191; and WHEREAS, sharing rents and fees the federal government receives in connection with wind and solar energy developments on federal land with the states in which those developments are located would be consistent with existing law regarding the disposition of royalties and fees received in connection with the production of certain fossil fuels and geothermal energy on federal land and would serve the same public purposes. NOW, THEREFORE, BE IT RESOLVED BY THE MEMBERS OF THE LEGISLATURE OF THE STATE OF WYOMING: Section 1. That Congress speedily enact legislation providing for the payment of fifty percent (50%) of all rents and fees received by the federal government in connection with wind and solar energy developments on federal land to the state in which those developments are located, consistent with existing law regarding the disposition of royalties and fees received in connection with the production of certain fossil fuels and geothermal energy on federal land. Section 2. That the Secretary of State of Wyoming transmit copies of this resolution to the President of the United States, to the President of the Senate and the Speaker of the House of Representatives of the United States Congress and to the Wyoming Congressional Delegation.
