Subject: Lowering the threshold for when a surety bond is required from a nonresident employer and amending bond amounts . Summary/Major Elements: This bill lowers the threshold for when a nonresident employer operating in Wyoming must provide a surety bond or other security. Before this bill, the threshold for an employer to provide a surety bond was when the employer expected to pay wages exceeding $10,000 monthly or $120,000 annually. This bill adopts the requiremen t to provide a surety bond when expected wages reach $4,000 in any month. Th is bill amends the required surety bond amount proportionately with the wages of the employee, beginning with a bond of $8,000 and increasing by specified increments for each additional $1,000 of expected monthly wages. ORIGINAL House Bill No . HB0018 ENROLLED ACT NO. 19, HOUSE OF REPRESENTATIVES SIXTY-FOURTH LEGISLATURE OF THE STATE OF WYOMING 2018 Budget Session AN ACT relating to labor and employment; amending the surety bond or other security requirements for nonresident employers; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 27 ‑ 1 ‑ 106 (a) and (b) is amended to read: 27 ‑ 1 ‑ 106 . Certain nonres ident employers required to post bond; exceptions. (a) All firms, corporations or employers of any kind who are nonresident employers and expect to pay wages in the state of Wyoming in excess of ten thousand dollars ($10,000.00) monthly or o ne hundred twenty thousand dollars ($120,000.00) annually four thousand dollars ($4,000.00) in any month as a result of conducting business within Wyoming, are required to file with the director of the department of workforce services a surety bond or other security meeting the requirements of this section, approved by the director . and the attorney general . (b) The bond or other security required by subsection (a) of this section shall be in the amount of twenty thousand dollars ($20,000.00) eight thousand dollars ($8, 0 00.00) plus an additional two thousand dollars ($2,000.00) for each one hundred twenty thousand dollars ($120,000.00) one thousand dollars ($ 1 ,000.00) or fraction thereof that the expected wages in any month exceed one hundred twenty thousand dollars ($120,000.00) annually . four thousand dollars ($4,000.00) up to expected wages in any month of twenty thousand dollars ($ 20 ,000.00) . For expected wages in any month that exceed twenty thousand dollars ($ 20 ,000.00), the bond or other security amount shall be one thousand dollars ($ 1 ,000.00) for each additional one thousand dollars ($ 1 ,000.00) or fraction thereof of expected wages . Section 2 . This act is effective July 1, 201 8 .
