A BILL

AN ACT relating to game and fish; providing for legislative approval and cancellation of agreements entered into or extended with federal agencies as specified; requiring the game and fish department to report on agreements entered into or extended with federal agencies as specified; providing a conflict of law provision; making conforming amendments; and providing for an effective date.

Agreements with federal agencies; reporting requirements.

(a)

On and after July 1, 2018, any
memoranda of understanding or cooperative agreements
specified in subsection (c) of this section
to be entered into or extended
b
y
t
he commission or the department
with
any
federal agency

shall
:

(
i
)

Include a provision
that
states the memorandum of understanding or cooperative agreement is subject to
approval and
cancellation by the legislature;

(ii)

B
e forwarded to the joint travel, recreation, wildlife and cultural resources interim committee for review and recommendation. The committee may submit recommendations, including proposed legislation authorizing
, cancelling or revoking
the agreement, for consideration by the legislature in the
next
succeeding legislative session.

(
b
)

Beginning July 1, 2018 and every three (3) years thereafter, t
he department shall submit
a
report to the joint travel, recreation, wildlife and cultural resources interim committee
on any
existing
memoranda of understanding or cooperative agreements
specified in subsection (c) of this section
between the commission or the department and any
federal agency
. The report shall
i
nclude a list of all existing agreements and the status
and operation of each agreement.

(c)

This section shall only apply to memoranda of understanding or cooperative agreements relating to
any species that ha
s
received a species status code under the
Endangered Species Act
or
sensitive species
under a
ny
federal agency species list.

d
)

If the provisions of this section conflict with any other provision of law in this state, the provisions of this section shall control.

(a)
