This act updates various statutes that govern motor clubs and the services they provide.

This
act updates the statutory definitions of "discount service," "emergency road service," "motor club," and "service contract" to reflect changes in the services offered by motor clubs.

This
act amends the requirement for annual renewal of a certificate of authority issued to a motor club. Instead, the certificate will continue until the Insurance Commissioner suspends or revokes
the certificate or the motor club requests its termination. Motor clubs must pay an annual fee and provide proof of the financial-security requirement
in order for
the certificate to continue.

act removes the requirement that motor clubs provide membership cards or certificates to members who enter into service contracts. Instead, motor clubs
must
provide some proof of membership to members.

For motor club service contracts, motor clubs must provide the exact location of a business office in the United States, rather than the location of a place of business in Wyoming. The service contract must also contain a bolded statement providing that the service contract is not a contract for insurance.

Definitions.

(a)

As used in this act:

(vi)

"
Discount service
"
means an arrangement by a motor club resulting in giving special discounts, rebates or reductions of price on gasoline, oil, repairs, parts, accessories or service for motor vehicles

or other goods and services
to holders of service contracts with the club;

(vii)

"
Emergency road service
"
means
the adjustment, repair or replacement
any act

by a motor club

consisting of fuel delivery, extrication, lockout service,
key replacement,
repair, replacement or other adjustment
of the equipment, tires or mechanical parts of a motor vehicle so as to permit it to be operated under its own power;

(xii)

"
Motor club
"
means a person directly or indirectly engaged
, either as principal or agent,
in selling or offering for sale, furnishing or procuring motor club service;

Service contract

means a written agreement whereby any person promises for a consideration to render, furnish or procure motor club service for any other person

Every certificate of authority issued to a motor club shall
expire annually on July 1, of each year, unless sooner revoked or suspended

membership card or certificate and shall be dated and signed by the motor club issuing it

Contents of service contract.

(a)

A service contract shall not be executed, issued or delivered in this state unless it contains the following:

(ii)

The exact location of its home office and

of its usual place of business in this state, giving street number and city

A statement in not less than fourteen (14) point
