Sponsored by: Representative(s) Laursen, Crank, Gierau, Miller and Simpson and Senator(s) Bebout and Von Flatern A BILL for AN ACT relating to underground public utility facilities; modifying requirements for architectural and engineering plans to include information concerning underground facilities; specifying information required to be provided by operators of underground facilities; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 37 ‑ 12 ‑ 302(b) is amended to read: 37 ‑ 12 ‑ 302 . Notice of excavation by excavator; information to be supplied upon notice; exceptions; penalty. (b) Any person requiring or designing preparing architectural or engineering drawings or designs that call for excavation in or adjacent to any public street, alley , sidewalk or right ‑ of ‑ way dedicated to public use or a utility easement shall obtain information from operators , as to the nature, location, and depth if known, of underground facilities . If the information is not available, the person requiring or designing architectural or engineering drawings that call for excavation shall determine at their expense the nature and location of the underground facilities. The person requiring or designing architectural or engineering drawings that call for excavation and shall make the information and location a part of the plan by which the excavators operate. Except as otherwise provided in this subsection, o perators shall upon request make available all records showing the location of underground facilities within ten (10) business days of the request and shall at the operator's expense u se reasonable care to mark the location of underground facilities in the same manner as provided i n subsection (d) of this section. An o perator may require additional information from any person making a request under this subsection including information concerning the person's criminal background history or professional credentials . An o perator may deny unreasonable or illegitimate requests made under this subsection and shall notify the person of the reason for denial within ten (10) business days of the request . Section 2 .
