Be It Enacted by the Legislature of the State of Wyoming:

(d)

The department of health shall

by rule

administer a state supplemental security income program entitling any individual receiving payments under the federal supplemental security income program with no other income during any one (1) calendar month, to a payment for each month the condition exists. The monthly payment under this subsection shall be established by the legislature within the department of
family service's

health's
biennial budget appropriation, which shall not be less than the required payment under applicable federal law.

Decisions of the department of health
under

subsection
regarding entitlement to payments
shall be subject to the contested case procedures of the Wyoming Administrative Procedure Act.

Section 2 of this act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
