Be It Enacted by the Legislature of the State of Wyoming:

(m)

On or before July 1, 2018, the department of health shall include all programs and functions previously assigned to the department of
family services
created by W.S. 9

(k)

On or before July 1, 2018, all programs and functions of the department of family services shall be transferred to the department of health created by W.S. 9

2005. The combined department shall be known as the department of health. Any statute, rule or legal or other document which refers to the department of family services shall mean the department of health which is the successor to the department of family services.

Section 2
.

(a)

The director of the department of health shall be the director of the
combined
department
as provided for in this act
unless otherwise removed by the governor.

(
b
)

The director shall plan for the transfer of all programs and functions from the department of family services to the department of health
. The
transfer
shall
become effective on or before July 1, 2018.

(
c
)

The transfer of programs and functions from the department of family services to the department of health shall be deemed a type 1 transfer as defined in W.S. 9
‑
2
‑
1707(b)(i).

(
d
)

The director
shall prepare a status report on the transfer of
all
programs and functions
from the department of family services
to the department of health. The status report shall:

(i)

Consider and make recommendation
s

as to whether the services of the department of health and department of family services may be
provided at
consolidated physical locations to maximize efficiency and convenience to the public
;

(ii)

Identify the costs to consolidate the services of the department of health and department of family services;

(iii)

Recommend programs and functions of the department of health and department of family services that may be further consolidated as a result of the
transfer required by this act
;

(i
v
)

Identify
any
statutory amendments, rule and procedural amendments and other regulatory amendments necessary
to
further
implement the
transfer of programs and functions from the department of family services to the department of health as required by this act
;

(v
)

Identify any other issues or factors relevant to the
transfer

o
f
programs and functions
from the department of family services to the department of health
as
required by this
act
.

(
e
)

No later than October 1, 2018, t
he
director
shall
submit the status report required by subsection (
d
) of this section to the governor, the joint appropriations committee
and the joint labor, health and social services interim committee and shall make the report available to the public.
The joint
labor, health and social services interim committee shall consider the report

and develop legislation it deems appropriate for consideration by the legislature in the 2019 general session.

Section 3
.

The validity of rules, regulations, contracts, amendments or other obligations of the department
of family services
is

not affected by this act. The rules and regulations shall continue in effect until amended or repealed by rules and regulations adopted by the
department of health as provided for in this act
.

Section 4
.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
