Sponsored by: Representative(s) Pownall, Barlow, Dayton, Hallinan and Pelkey and Senator(s) Baldwin, Von Flatern and Wasserburger A BILL for AN ACT relating to offenses against the person; providing that assault, battery or unlawful contact against a health care provider is a high misdemeanor; providing a definition; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 6 ‑ 2 ‑ 501(c), (d), (h) and by creating new subsections (j) and (k) is amended to read: 6 ‑ 2 ‑ 501 . Simple assault; battery; penalties. (c) S imple assault is a misdemeanor punishable by a fine of not more than seven hundred fifty dollars ($750.00) , e xcept as otherwise provided by subsection (j) of this section . (d) B attery is a misdemeanor punishable by imprisonment for not more than six (6) months, a fine of not more than seven hundred fifty dollars ($750.00), or both , e xcept as otherwise provided by subsection (j) of this section . Notwithstanding any other provision of law, t he term of probation imposed by a judge under this subsection may exceed the maximum term of imprisonment established for the offense under this subsection provided the term of probation, together with any extension thereof, shall in no case exceed one (1) year. (h) A n unlawful contact under subsection (g) of this section is a misdemeanor punishable by imprisonment for not more than six (6) months, a fine of not more than seven hundred fifty dollars ($750.00) or both , e xcept as otherwise provided by subsection (j) of this section . (j) If a person commits an offense under subsection (a), (b) or (g) of this section against a health care provider while the health care provider is acting within the scope of their employment , the person is guilty of a high misdemeanor and shall be punished by imprisonment for not more than one (1) year, a fine of not more than five thousand dollars ( $5 ,000.00), or both. (k) As used in this section, "health care provider" means a person who is licensed, certified or otherwise authorized or permitted by the laws of this state to administer health care in the ordinary course of business or practice of a profession.
