A BILL

for

AN ACT relating to the administration of government; requiring state agencies to prepare a report relating to managerial and nonmanagerial employee ratios as specified; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section
1
.

(a)

Not later than September 4, 2018, each state agency shall subm
it a report to the governor and
the joint appropriations committee regarding:

(
i
)

The number of manager
ial
and nonmanagerial employees
currently
employed by the agency;

(ii)

The ratio of managerial employ
ees to nonmanagerial employees,
based on the data
specified in
parag
raph (
i
) of this subsection;

(iii)

The
manner in which
vacant managerial and nonmanagerial positions may affect the ratio specified in paragraph (ii) of this subsection; and

(i
v
)

Unless clearly impracticable, a plan for the agency to reorganize itself to create a ratio of managerial employees to non
manageri
al employees of not less than
eight (8
) to one (1)
by June 30, 2020
and, if necessary,
any recommendations for legislative action
required to achieve the
reorganization
.
If
reorganization is
determined to be clearly impracticable, the agency shall provide detailed reasons in support of its determination.

(b)

The governor
may exempt state agencies with twenty
‑
four (24) or fewer total employees from the requirements of subsection (a) of this section
.

(c)

As used in this section:

(
i
)

"Managerial employee" means an employee who has two (2) or more subordinates and whose duties include a supervisory role;

(ii)

"
S
tate agency
"
includes
all
agencies, boards, offices, commissions and departments
of the executive branch of government
, but shall not include the legislative
and
judicial branches.

Section 2
.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
