Summary/Major Elements: Existing law provides for confidentiality of certain communications between a legislator and legislative staff. This act provides that the recording or broadcast of a communication made by a legislator or legislative staff shall not be deemed to be confidential to the extent the communication is audible on the official legislative service office recording or broadcast of a public meeting of a joint interim committee, select committee or task force. ORIGINAL House ENGROSSED Bill No . HB0192 ENROLLED ACT NO. 51, HOUSE OF REPRESENTATIVES SIXTY-FOURTH LEGISLATURE OF THE STATE OF WYOMING 2018 Budget Session AN ACT relating to the legislature; providing that communications audible on an official recording or broadcast of an interim committee meeting or other meeting are not confidential and privileged as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 28 ‑ 8 ‑ 116(a)(intro) and by creating a new subsection (d) is amended to read: 28 ‑ 8 ‑ 116 . Confidential communications. (a) Except as otherwise provided in subsection (d) of this section and u nless the privilege is waived by the individual legislator involved, the following shall be deemed confidential and privileged: (d) The recording or broadcast of a communication made by a legislator or legislative staff which would otherwise be confidential and privileged under this section shall not be deemed confidential and privileged to the extent that t he communication is audible on the official legislative service office recording or broadcast of a public meeting of management council, the joint appropriations committee, the management audit committee, a joint interim committee, select committee or task force. Nothing in this subsection shall be deemed to waive the privilege for any communication or portion of a communication that is not audible on the recording or broadcast. Section 2 . This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
