Sponsored by: Joint Travel, Recreation, Wildlife & Cultural Resources Interim Committee A BILL for AN ACT relating to bingo and pull tab game events; providing for local control over bingo and pull tab game events as specified; authorizing fees; making conforming amendments; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 16 ‑ 13 ‑ 101 and 16 ‑ 13 ‑ 102 are created to read: CHAPTER 13 BINGO AND PULL TAB GAME EVENTS 16 ‑ 13 ‑ 101 . Definitions. (a) As used in this chapter: ( i ) "Charitable or nonprofit organization" means as defined in W.S. 6 ‑ 7 ‑ 101(a)(xi); ( i i) "Governing body" means the board of county commissioners of a county or the governing body of a city or town; ( i ii) "Ordinance" means an ordinance, resolution or other proceeding by which a governing body takes formal action and adopts legislative provisions and matters of some permanency; (i v ) "Pull tab game event" means an event at which a player purchases a pull tab game piece that is made of paper or paper products with concealed numbers or symbols that the player must expose, often by tearing off a covering tab, to determine wins or losses. "Pull tab game" includes charitable gaming tickets, break opens, banded tickets, jar tickets, tip tickets, pickle cards, instant bingo tickets and other names designated by manufacturers, distributors, players or ordinances of the governing body . 16 ‑ 13 ‑ 102 . Bingo and pull tab game events; permits ; fees . (a) No person shall conduct any bingo game or pull tab game event within the boundaries of a governing body's jurisdiction without first obtaining a permit if required by the governing body in accordance with this section. (b) A governing body may , by ordinance, authorize the conduct of bingo games and pull tab game events within the boundaries of the governing body's jurisdiction . The ordinance shall: ( i ) Specify the procedure and any requirements, including fees not to exceed one percent (1%) of gross sales , for applying for a permit if required by the governing body ; (ii) Authorize only bingo games and pull tab game events conducted by a charitable or nonprofit organization that ha s been in existence in this state for at least three (3) years; (i ii ) Require players of bingo and pull tab games to be eighteen (18) years of age or older; (iv) Require that bingo cards and tickets and pull tab games are sold only on the premises owned or occupied by the charitable or nonprofit organization; (v) Require a charitable or nonprofit organization, in conducting bingo games and pull tab game events, to use only volunteers who are bona fide members of the organization or employees or contractors who are paid by the organization to assist in the operation of the games and events; (vi) Require at least forty-nine percent ( 49 %) of all gross sales of a bingo game or pull tab game event to be redeemed as winnings each month. The net proceeds after payment of winnings shall be restricted as follows: (A) No more than forty percent (40%) of net proceeds shall be paid to distributors or manufacturers of supplies or equipment necessary to conduct the event; and (B) The organization shall donate annually at least seventy ‑ five percent (75%) of the net proceeds remaining after payment for all costs and supplies to a bona fide charitable or benevolent purpose. (vii) Authorize the charitable or nonprofit organization conducting the bingo game or pull tab game to purchase supplies or equipment necessary to conduct the game from a distributor or manufacturer at a price based on a per card or per pull tab basis subject to the limitations provided in subparagraph (vi)(A) of this subsection. Section 2 . W.S. 6 ‑ 7 ‑ 101(a)(iii)( D) ( intro) is amended to read: 6 ‑ 7 ‑ 101 . Definitions. (a) As used in this article: (iii) "Gambling" means risking any property for gain contingent in whole or in part upon lot, chance, the operation of a gambling device or the happening or outcome of an event, including a sporting event, over which the person taking a risk has no control, but does not include any of the following: (D) Bingo games conducted, or pull tabs sold, by charitable or nonprofit organizations where the tickets for the bingo are sold only in this state and the pull tabs are sold only on the premises owned or occupied by the charitable or nonprofit organization provided that: and pull tab game events authorized by W.S. 16 ‑ 13 ‑ 102. Section 3 . W.S. 6 ‑ 7 ‑ 101(a)(iii)(D)(I) through (V) is repealed. Section 4 . This act is effective July 1, 2018. (END) 1 SF0004
