Sponsored by: Joint Transportation, Highways & Military Affairs Interim Committee A BILL for AN ACT relating to criminal procedure; authorizing release of criminal history record information of military members as specified; requiring submission for fingerprinting of military members as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 7 ‑ 19 ‑ 106(a)(xv) and 7 ‑ 19 ‑ 201(a)(viii) are amended to read: 7 ‑ 19 ‑ 106 . Access to, and dissemination of, information. (a) Criminal history record information shall be disseminated by criminal justice agencies in this state, whether directly or through any intermediary, only to: (xv) The military department for purposes of obtaining criminal history record information including any completed investigations on prospective employees , or volunteers or military members serving in active duty or in the Wyoming national guard . The dissemination of criminal history record information authorized by this paragraph shall only occur if required by the department for a position with the department, training decisions, deployability, mobilization or security clearance ; 7 ‑ 19 ‑ 201 . State or national criminal history record information. (a) The following persons shall be required to submit to fingerprinting in order to obtain state and national criminal history record information: (viii) Prospective employees of or volunteers with the Wyoming military department or active duty or Wyoming national guard military members if the department requires prospective employees or volunteers, or both, to submit to fingerprinting in order to obtain state and national criminal history record information as a condition for a position with the department , training decisions, deployability , mobilization or security clearance ; Section 2 .
