A BILL

for

AN ACT relating to education; establishing the educational program commission; establishing commission duties; directing the department of education to staff the commission; requiring reports; providing for initial staggered terms; providing an appropriation; and providing for an effective date.

Creation of commission; appointment and composition

(a)

The Wyoming education
al
program commission is created to consist of fifteen (15) members appointed by the governor
and approved with the a
dvice and consent of the senate
in accordance with W.S. 28
‑

101 through 28

‑

. The governor shall appoint members of the commission as follows
:

(i)

One (1)
employee of
the University of Wyoming;

(ii)

One (1)
employee of a Wyoming community college or of the community college commission of Wyoming
;

(iii)

One (1) member
of
an association representing Wyoming school boards;

(iv)

One (1) member
of
an association representing Wyoming public school teachers;

(v)

One (1) member
of
an association representing Wyoming public school administrators;

(vi)

One (1)
employee of
the department of workforce services;

(vii)

One (1)
member of the
state board of education; and

(viii)

Eight (8)
individuals
who represent
a diverse collection of business and industry interests. To the extent practica

usiness or industry relating to
trade unions,
technology services, tourism, recreation,
agriculture or ranching,

medicine
, energy
or manufacturing
.

(b)

The commission shall select a chairman and a vice

chairman from among its members.

(c)

Commission members shal
l be appointed to a term of six
(

) years. No person shall be appointed for more than two (2)
six
(

) year terms.
No person shall serve on the commission for more than twelve (12) years.

(d)

Any
commission
member may be removed

as provided under W.S. 9

202.

(e)

All vacancies from any cause shall be filled by appointment by the governor as provided in W.S. 28
‑
12
‑
101. A commission member appointed
as a result of
a vacancy shall serve the balance of the term of the commission member who vacated the position.

)

Members of the commission shall receive mileage and per diem for attending commission meetings in the same
manner and
amount as state legislators and shall receive no other compensation for serving on the commission.

Powers and duties

(a)

The Wyoming education
al
program commission shall convene once every three
(3)
years
, beginning in 2018,
at a series of four
(4)
meetings
to review the state's educational program contained in W.S. 21
‑
9
‑
101 and 21
‑
9
‑
102
,
the Hathaway scholarship program's success curriculum as defined in W.S. 21
‑
16
‑
1307
and state and school district education accountability systems
. The commission shall consider
whether the educational program,
the success curriculum
and the accountability systems

offer
each Wyoming public school student
the opportunity
to be
come

equipped to be
a citizen, participant in the political system and
to be competitive both
intellectually and economically.
During the year the commission meets, it
shall report its recommendations to amend the educational program
,
the success curriculum
or accountability systems
, if any,
to the joint education interim committee by September 1
of that same year
.

b
)

The department of education shall staff the commission
as required by the commission. The state superintendent
of public instruction
shall function as secretary to the commission. The department of education
and
the state's school districts shall collect and provide information requested by the commission.

(c)

The department of education shall
fund

the
necessary operations of the commission. The
state superintendent
shall include
an amount within the department of education's
biennial budget request
submitted under W.S. 9
‑
2
‑
1013 for purposes of implementing this section.

Section 2.

(a)

Notwithstanding W.S. 21
‑
2
‑
901 as created by section 1 of this act, initial appointments to the board shall be staggered terms as follows:

(i)

Seven (7) members shall be appointed to a three (3) year
term
; and

(ii
)

Eight (8) members shall be appointed to a six (6) year term.

Section 3
.

There is appropriated
twenty
‑
five thousand dollars ($25,000.00) from the school foundation program account to the department of education for purposes of
making
required payments under W.S. 21
‑
2
‑
9
01(f), as created
by this act
.
Notwithstanding any other provision of law, this appropriation shall not be transferred or expended for any other purpose and any unexpended, unobligated funds remaining from this appropriation shall revert to the school foundation program account on June 30, 2019.

Section 4
.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the
Wyoming Constitution
.
