AN ACT relating to pari-mutuel wagering; creating the horse racing industry development account; creating the pari-mutuel reserve account; providing for distribution of funds to the accounts; specifying use of funds in the accounts; authorizing grants to counties to develop and expand the horse racing industry in the state as specified; imposing duties on the state loan and investment board; providing for rulemaking; and providing for an effective date.

(a)

There is created the horse racing industry development account to be administered by the state loan and investment board. The account shall consist of those
funds credited to the account
under W.S. 11

and all other funds received
by the board
from contributions, grants, gifts, transfers, bequests and donations to the account. The
board may
accept grants, gifts, transfers, bequests and donations
and shall deposit those funds to the account
.

207, funds within the account shall not lapse or revert until directed by the legislature and shall remain available for
distribution as authorized by
this section.

(b)

Funds within the horse racing industry development account shall be used
to provide grants to counties to
promote the
develop
ment
and expan
sion of the
horse racing
industry in the state
.

The state loan and investment board shall establish by rule an application procedure and eligibility requirements for grants
in accordance with
this section. Grant applications shall include
a description of the intended use of the grant monies
by a county
.

(c)

The state loan and investment board shall provide grants subject to the following:

(i)

Priority for
grant awards
shall be given
first to facilities that operate live flat track horse racing events and then to facilities that operate horse racing related events
;

(ii)

Grants may only be awarded to a county upon written opinion of the attorney general certifying the legality of the
intended
use of the grant monies by the county.

(d)

A county receiving a grant under this section
shall
only
use the grant monies to develop and expand horse

racing facilities owned by the
county or other horse racing facilities as approved by
resolution
of the county
commissioners
.

)

The state loan and investment board may
adopt other rules as necessary to implement this section.

(d)

All sums paid to the commission under this act except contributions from permittees to the breeder award fund, amounts paid under paragraph (b)(iii) of this section, fines and penalties shall be credited to the pari
‑
mutuel account which shall be used by the commission for the payment of all expenses incurred in enforcing this act. All fines and penalties collected under this act shall be paid to the state treasurer and credited as provided in W.S. 8
‑

109. The state treasurer shall pay out of the
account all warrants drawn by the state auditor, upon vouchers issued and signed by the president, vice
‑
president or executive secretary of the commission. The commission shall keep an accurate and true account of all funds received and all vouchers issued by the commission. All funds received and all vouchers issued by the commission shall be audited at least biennially by the director of the state department of audit or his designee and a copy of the audit shall be delivered within thirty (30) days after completion to the governor and the commission. The costs of the audit shall be borne by the commission. The members of the commission shall receive per diem and mileage as provided in W.S. 33
‑

‑
302(a)(vii), and compensation of fifty dollars ($50.00) for each day during which they are actually engaged in the discharge of their duties. The total expenses incurred by the commission shall not exceed the total amount in the pari
‑
mutuel account.

At the end of each fiscal year, all
unencumbered, unobligated funds within the pari
‑
mutuel account
that
exceed the anticipated expenses to be incurred by the commission during the next fiscal year
