State employee leave for organ donation.

(a)

A full
‑
time state employee shall receive:

(
i
)

Up to one hundred twenty (120) hours of leave with pay during each calendar year to use during those hours when the employee is absent from work because
of the employee's donation of any portion of an adult liver or because of the employee's donation of an adult kidney;

(ii)

Up to fifty
‑
six (56) hours of leave with pay during each calendar year to use during those hours when the employee is absent from work because of the employee's donation of adult bone marrow.

(b)

The employing entity shall compensate a full
‑
time state employee who uses leave granted under this section at the employee's regular rate of pay for those regular work hours during which the employee is absent from work as a result of the donation, provided that not more than a total of one hundred twenty (120) hours of leave with pay shall be compensated under this section in any twelve (12) consecutive month period.

(c)

Each employing entity shall provide information about this section to its full
‑
time state employees. Rules or policies necessary or convenient to implement the provisions of this section may be adopted by:

(
i
)

The human resources division for the executive department;

(ii)

The management council for the legislative department;

(iii)

The district court judicial conference for all district courts, and the chief justice of the supreme court for the remainder of the judicial department;

(iv)

The University of Wyoming for university employees.

(d)

A state employee shall only be eligible to receive the leave specified in paragraphs (a)(
i
) and (ii) of this section after that employee has exhausted all of their accrued vacation leave and sick leave.

(e)

As used in this section:

(
i
)

"Full
‑
time" means a normal work week of thirty
‑
two (32) or more hours worked on a predominantly yearly basis. Faculty of the University of Wyoming who
work at least two (2) semesters in each school year shall be deemed as working on a predominantly yearly basis;

(ii)

"State employee" means all state executive, judicial and legislative branch employees, including the University of Wyoming.
