Declaring a vacancy by county commissioners.

(a)

The board of county commissioners may declare vacant the office of a county officer if the officer is absent from his office without leave of the board for more than ninety (90) business days in any one (1) calendar year. The board shall provide notice to the officer and conduct a fair investigation of the absence before declaring a vacancy under this section.

(b)

Whenever a vacancy occurs in any county office under the provisions of this section, it shall be filled as provided by law.

(c)

This section is supplemental to all other statutes concerning removal of county officers.
