Be It Enacted by the Legislature of the State of Wyoming:

(a)

Upon approval of the governor and in consultation with the department of insurance and the department of health, the department of administration and information shall submit health care claims data from the state
employees' and officials' group insurance plan to a multi
‑
payer health care claims database that includes data from Wyoming employers if the governor finds:

(i)

That the costs of submitting the data to the claims database are reasonable in light of the likely benefits of submitting the data to the claims database for Wyoming employers, the state of Wyoming and the Wyoming public;

(ii)

That, without disclosing personally identifiable information, the database makes sufficient information available to the public to allow the database to serve a substantial public benefit;

(iii)

That submission of the data to the database will be beneficial to Wyoming's employers and residents;

(iv)

That, pursuant to a written agreement, data submitted to the database will be used, disclosed and stored in compliance with all relevant state and federal
laws and that no personally identifiable information will be publicly disclosed;

(v)

That other relevant factors weighing against the submission of data to the claims database do not substantially outweigh the benefits of submitting the data.

(b)

All data submitted to a multi
‑
payer health care claims database pursuant to subsection (a) of this section shall be submitted, stored and disclosed in compliance with all state and federal laws regarding disclosure of confidential health care data and no personally identifiable information shall be publicly disclosed.

(c)

The department of health may provide in
‑
kind services for data collection and analysis in lieu of the state paying part or all of any monetary charges to any claims database under subsection (a) of this section.

(d)

Data submitted to a multi
‑
payer health care claims database pursuant to subsection (a) of this section shall be considered a public asset, shall not become the property of any person other than the state of Wyoming and,
subject only to confidentiality or other limitations imposed by state or federal law, may be used to review and improve operation of the state employees' and officials' group insurance plan.

(e)

This section is repealed on July 1, 2025.
