Implementation requirements for medical marijuana.

A BILL

for

AN ACT relating to public health and safety; requiring an implementation report on medical marijuana; providing for identification of medical conditions that benefit from treatment with medical marijuana; providing for recommendations and a timeline related to implementation of medical marijuana; providing an appropriation; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1
.

(a)

The state health officer, with the assistance of the department of health, the board of pharmacy, the state board of medicine, the state insurance commissioner and the
attorney general, shall develop a report on the implementation of medical marijuana in Wyoming. The implementation report shall:

(i)

Identify medical conditions that are, according to medical evidence, likely to benefit from treatment with medical marijuana;

(ii)

Include recommendations on how to regulate medical marijuana prescriptions including any recommendations related to prescriber and dispenser regulation and responsibility;

(iii)

Include recommendations on how to prevent wrongfully obtained prescriptions and misuse of medical marijuana and how to promote the legitimate medical use of marijuana;

(iv)

Recommend a timeline for implementation and regulation of medical marijuana in Wyoming;

(v)

Identify and recommend statutory changes that are necessary to implement the use of medical
marijuana in Wyoming in accordance with the information in the report.

(b)

The state health officer shall provide the report required under this section to the joint labor, health and social services interim committee not later than September 30, 2021.

Section 2.

There is appropriated thirty thousand dollars ($30,000.00) from the general fund to the department of health. This appropriation shall be for the period beginning with the effective date of this act and ending June 30, 2022. This appropriation shall only be expended for costs necessary to prepare the report as required by section 1 of this act. Notwithstanding any other provision of law, this appropriation shall not be transferred or expended for any other purpose and any unexpended, unobligated funds remaining from this appropriation shall revert as provided by law on June 30, 2022.

Section 3.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
